Well, I'm not entirely sure, and I'm too lazy to go to the Secretary of State's office to look to see what treaties are still in force. However, I can take a guess-which would be yes, it would be allowed. Reason being, existing contracts and treaties give the various Indian nations sovereignty. So, is herb was a traditional ritual, then it would be allowed. Though (to use an economic term) spillover benefits occur, then perhaps Congress may not allow it.SASSZAIN wrote:aren't Native american tribes still allowed to smoke herb.. or was that a fictional rumor..
